Section 89 Civil Procedure Code, 1908 – Settlement of Disputes outside the Court

As per Section 89 of CPC, where it appears to the Hon’ble Court that the disputes between the parties may be settled and there exists elements of settlement which may be acceptable to both the parties then the Hon’ble may refer the disputes to arbitration, to mediation and refer the disputes to Lok Adalat as per Legal Services Authorities Act, 1987. Effect of this will be that this compromise between the parties and shall follow such procedure as deemed fit for judicial settlement.
